We were retained by a tier two supplier to one of the Big Three U.S. automakers embroiled in a breach of contract dispute with its tier three supplier over its manufacture and sale of printed circuit board assemblies to be embedded in automotive dashboards manufactured and assembled by our client intended to perform user commands. The project team performed various detailed analyses to determine the losses suffered by our client as well as analyzed the losses allegedly suffered by the tier three supplier. Financial models were built to determine the economic effects and potential damages caused by the claims of breach of contract, breach of warranty, and fraud being alleged by both parties. An expert report was issued, and our expert sat for a deposition. The matter was ultimately heard by a panel of three arbitrators assembled in Detroit, during which our expert testified twice. The decision of the panel is pending.
